My son has an interim IVO which is to be heard next week he just went through McDonalds drive thru for lunch and noticed his ex partner vehicle in car park on leaving MCDonalds he lives in a small town has he breached this order

Did he know she was there?

Did he move away from the area as soon as he saw her car?

Did she see him?

The answers to these will help determine in he breached the order.

He didn’t see her car until after he went through drive thru then he drive away. Not sure if she she is car.

I believe he should do noting about this, if confronted about the matter he has a reasonable explanation coupled with the fact that as soon as he became aware he moved away.

Yeah, the cops will see it as a technical breach... They might bring him in for a chat, but small towns... My ex complained when I bumped into her at Coles. The only supermarket in my small town.

I got called in for an interview- the cops were good. They could see that this technical breach was nothing more and my ex was just trying to get me into trouble... The cops gave me a warning. Not about the breach, about how keen the ex was to use the ivo to cause me maximum problems...
If he gets called into the cop shop - tell him to be on his best behavour...
