I have become aware of a significant encroachment on my property boundary by a neighbouring property. I became aware of this when my next door neighbour had a survey  prior to a rebuild of his property. I wish to reclaim my land as it would provide significantly better access to the back of my shed and enable greater use of my land. As this is in inner Sydney, residential lots are very small and expensive.

What is the best strategy to engage my neighbour? He built a 2 metre retaining against my property line when he built his house, 10 years prior to me moving in. What are my legal rights? I am prepared to purchase a new survey  to prove my case but I believe the neighbour would fight all the way to Land and Environment court, a situation I wish to avoid.

Any advice?
