If you have proof through the survey done, if you haven't already, put it together with a letter explaining what you want to do and asking the neighbour for their input. You maybe surprised at their response if you invite them to have an opinion. Of-course they may react the way which you think they will too. If you are adamant that you want this gate and the neighbours are being difficult and refuse to agree, then your next option is to take this to a lawyer that specialises in this type of law and get some advice. It may end up in court if the neighbours won't come to the party, so you will have to be prepared for that.
