Dear cdh, The easiest way to get orders from the Family Court is by consent. That is, you file an application for 'Conset Orders'. To do this both parties must agree to the terms and both sign the application form. If your ex will not agree, then you would be well advised to get a solicitor start the formal court process. Divorce is a seperate process which is now processed through the Federal Magistrates Court (except in WA). The AussieLegal Family Law Kit is designed as a general background education on how the court works with examples of typical property settlements, child residence and access etc. It also includes some prescribed court forms which are otherwise freely available form the courts. It will not designed for situations like yours.
