Hi Everyone, I’m curious to know if child Care Centres as a business are bound by Section 36(1) of the Competition and Consumer Act 2010 (Schedule 2). The scenario is some Child Care Centre are charging fees on a Public Holiday but not providing any service to the families. Ours wants to start. How would this be legal if charging fees when there is no intention to provide a service is banned under the Act? We intend to challenge, but would love some input or any knowledge of this coming up as an issue before, or how Child Care Centres are able to circumvent their obligations under the Act. Many thanks.
