what are chances of getting visa for partner if i marry her while here on tourist visa as opposed to fiance visa.i have previously had finace visa.would this count against me.she is from philipines will it be harder because of lack of her finances. greg

I don't think that is relevant, if she overstays her tourist visa, and they find her, from what I hear they will deport her whether she is married or not. Do some ringing around, you don't have to give your name, but don't ring those shoddy immigration places, ring the Dept for Immigration and get the facts.

BIUi mean tho i didnt intend her to over stay visa just get married while here.will it be easier to process and can she stay while dexcide the marriage visa application

the first thing you have to do is to check if her tourist visa has a condition 8503 or 'no further stay' on it. if it does, she cannot be granted any further visa while in Australia, unless the condition is waived (not easy to get the waiving).
if it does, you can lodge the partner visa onshore and she will be granted a bridging visa while waiting for the visa to be processed. whether she will get the partner visa would then depend on whether you can establish genunie and continuing relationship (a marriage certificate alone is not enough although it is a big plus).
not all migration agents are bad, by the way.

why do immigration take dim view of being unemployed.when in philipines a woman is alomst unemployable and chances of savings very remote when average income is less than 3000 aus p/a,and if no job no hassles being here 3 months yet i have had go thru ringer like marriage visa just to get tourist visa and its still iffy coz no job.i guaranteed pay all expenses.travel insurance,return airfares, tough going

also what if we decide to marry while on holiday here for 3months.what does she need to bring apart from id.shes never been married.would it be quicker and cheaper this way.could i get the bridging visa.it will only be 6 months we have known each other.greg

6 months isnt long enought to have known each other, immi wants more! so your chances arent great!!!
Did you meet her here or over there? if over in Philipines how many times did you visit her as this would help you alot?
Im asking as if you go for the partner visa immi will require this:
1. immi says over 12mths + relationship, marriage cert( with pics,proof on living together, bills in both names, joint bank accounts etc.)
2. what assets she has as she needs to show that. & what income your on etc (any tax returns in the past etc)
3. medicals need to be done on her ( not cheap either)
4. you need 2 people on both side to say that your having a real geniune relationship.
5.check out the immi website on what else you need as Different rules apply for philipines to come over, they must show they have money,assets & sometimes a job that pays tax back in their country.

& If your finding it hard now on your finances, its going to be alot harder if she does get bridging visa as she's not intitle to any money from the goverment & your responsible for all her needs for over 2 years if it does get approved.

My brother had his partner visa through but they did it offshore back in the philipines, it took 4 months but had known each other for over 12months. He brought a house & place it in her name as she didnt have any assets to show nor paying tax in her country even thought she did work. He flew over 4 times & stayed there a few weeks to show he was committed to their relationship. He paid for everything!! His wife is over here now and on course so she can work afterwards but my brother pays that as there's no help, her english isnt that great so there's free course she can go on.

thanks for that misty,my issue is how the hell do you have assets in phiolipines.hard enuff here,no chance of that as its different kettle of fish over there.u dont even get free medical if no money or job.u sick u die.wondering if prospective marriage visa quicker but sounds like philipines is slow at moving.in mean time got keep flying back and costs which couild be covering immigration are going.the bridging visa means she can stay but just cant work,that be ok at least we together.any ideaa costs.

Ring immigration up see if there's any condition to her visa first!!
I understand about how hard it is in the Philippines but if your going to fly out make sure next visit you open up a Joint Bank Account(with funds), get married and file the visa over there as it can be alot quicker. Marriage visa offshore are $1705 + medicals cost + police checks & make sure you have everything from Aus with you!!
Also look at the website under partner's visa it tells you how much the Prospective Marriage Visa (Subclass 300)will cost($1040)and what you need to do for both parties. (its valid for 9 months) if they approve it,(there' no guarantee)after that you need to pay a further $825

hi greg, i was married in Melbourne on my tourist visa. The celebrant just asked for my passport and birth cert.

as long as the relationship is genuine and you guys can provide proof, then the next visa wouldn't be a problem.

the hassle is the waiting time.

sorry liz if see this 1 more question.did you get multpile enrty visa or did you have to reapply for new tourist visa.were there any conditions on it.also you must have got married on your first visit.so did you change your name etc for passport or leave as maiden name.and if did how you go bout marriage certs

nope, i was on the single entry 3 months valid visa with NO FURTHER STAY REQUIRED. It was my 1st trip to Australia. SO as soon as I went back to Manila I have to change everything.. My licenses and my passport. Then I applied for a tourist visa again with my married name.

Marriage cert is not a problem, the celebrant married us without any hassle. Just asked some q's weather the intentions are true for both parties and ofcourse if the relationship is genuine. Took us 2 weeks to get the marriage cert because it was a holiday here at that time.
