Hi All,
I was stitched up by truscom/FC and AIF.
We need to get a class action going,perhaps Pk or slater and gordon?
I do know a solicitor who I will be seeing sunday,he does commercial and contract.
You are very welcome to contact me after hours by mobile or send email direct.A solicitor friend said if many people say we were duped ( I was told the equip was mine if I stayed five years) we have a much greater chance as the courts will see a grand con.

I am starting to think we dont have a chance if we get a smaller law firm to represent us (no offence to smaller law firms, my auntie owns her own law firm).
I agree with a couple of the other users, I think we need someone big who can look at this case and say 'piece of cake' . I have a couple of friends that work for massive law firms, maybe I can talk to them for a start..
Let me know what you think about the whole big law firm thing... and please email me if you havent already because WE NEED AS MANY NAMES AS POSSIBLE TO MAKE THIS WORK!

I understand what your saying, lets al least wait and see what some of our solicitors are going to say, i know my solicitor quite well he has been my fathers solicitor for almost 25 years and mine since i started a business, i have always trusted him and i know that if he feels we have a case and that he is too small to take it on he will tell me, i hope to hear from him today or by monday at least as i know he recieved my paper work yesterday and was looking over it around lunch time. so please before we jump to high lets get as much information and enough time for people to gather all their paper work together. i agree the more we have the better the case.

I was stitched up by Forte Connect and Truscom - the leasing company was EFS, I think we will find in time that the leasing companies were not into it like Truscom were, I think these companies just took the work on - they would have looked into it to make sure that their contracts were air tight, as these were not leases they were Rentals (in my case anyway) - Rental Agreements take on a whole new avenue - I voluntairly liquidated my company that had the agreement with Forte and EFS. However as I was the guarantor for the leased (rented) goods I had to pay out EFS. When I spoke to the guy at EFS he did tell me that they were not and hadnt in some time dealt with Truscom. I was first signed up to another leasing company who wouldnt agree to the dollar buy back, so they got EFS involved, who mind you werent going to give me the dollar buy back until I threatened them with fair trading action - they agreed in the end. I know I said it before in whirlpool - but check your contracts if you think you had a dollar buy back make sure that it is stated on your lease with the finance company, because if it does turn to sh*t and you have to pay back the money over the course of the lease you can argue now that you at least keep the goods.

Also my last post on whirlpool was hidden, I wanted to let everyone know that Telstra have been saying that Forte are bankrupt. This has not been confirmed on the ASIC site, and I dont know how Telstra would find out. Sales people will say anything to get a sale, so be aware that even people that work at Telstra can lie.
I still suggest to all to churn, but all I say is to be weary of what you are told, because the entire industry now know about Forte and their sales people will say what you want to hear to sign you up.

Also, just letting you know, my Techs in Sydney has told me that he has had his team running to between 6 to 10 sites a day getting rid of the precodes from Forte connect customers.
I will get them to pass on my details and I will forward this forum link to them and get them to join in on the suit.

I agree with Robert, Telstra might say anything to get the sale.
But they are also very powerful in the telco industry so it wouldnt surprise me if they knew everything.
I cant think of any other reason of why they don't answer their phones and why our lines are disconnected. Anyway, Im sure Robert would know a lot more about this than me and thanks again for your help Robert.

I am not doubting that they are going bad, and Telstra are a very powerful telco. All I want people to realise is that Telstra might know, but the people in the call centre are not going to be in the same loop as mangement.
there are sales people out there are without morals, and you all have been burned very badly by a company that does not care about the lives they could be wrecking and businesses they could be sending under by their absolutely foul criminal act. You all need to go into any agreement with your eyes wide open and get the facts before you sign, or being over the phone agree to anything.

A class action is probably the way to go, i know of others doing this who were in a similair situation with other bundling companies, only problem is this can take time. the finance companies definately know who there dealing with so dont let them off the hook. every vendor is suppose to have RRP pricing and if they did there is now way a dialler would go through at $1100!
And Telstra are a little expensive but they do have good plans on 12/24 month contracts, exit fees if you break them, but you know you will always have a service and no headaches of what you are encountering now.
And TCSR im sure you will be cleaning up helping these people, and bagging telstra come on? Telstra probably wouldnt know but would be saying this as Fc customers would be ringing them to find out whats happening with there lines. Are FC actually in Administration??

Actually Huru, I have spoken with some people that have been stung and suggested them to go to Telstra and sign up. I have not pushed my product, and only done so if asked.
I am not bagging Telstra, I am bagging sales people that are saying things to get customers that have not yet been confirmed. I only used Telstra because these were the incidents that were mentioned in the previous forum. "Telstra staff saying that they have gone bankrupt". I pass customers onto them when they need it, so I would not do this.

if the company is not in administration then you can chase FC, if they are there will be an administrator apppointed to salvage what he can from the company and possibly sell it or liquidate it.
Chances are they have gone broke if they cant pay there wholesalers.It will show on Asics whether they are but i dont know there ABN.

just spoke to aif. They said that my contract is a rental agreement and that I will not even own the equipment once the rental term is over. They also said that they don't have to tell me the amounts that the equipment is worth. Is this the same for everybody else?
