I divorced May 2006. Family court orders were issued in November 2005 regarding property settlement, children etc. My 2 girls were to stay with their mum who would retain the marital home and all possessions. The orders stipulated that I was to be taken off the home title and she would be required to refinance and take over the mortgage. I signed over my share on the property title. Six days later the court orders were broken and I gained full custody of one daughter. Since the court orders were issued, my ex failed to pay the mortgage and personal loans. Since she went into arrears she was unable to refinance inorder for my name to come of the mortgage. The house was foreclosed in June 2006. She subsequently went bankrupt. I abided by the court agreement and continued to pay child support and sign the papers for title change. But it seems that I am now solely responsible for all the joint debts especially the mortgage as she has gone bankrupt. I had paid all debts up to date prior to signing the title over. Am I financially liable for the debts, arrears and mortgage that my ex-wife accrued after the issue of those court orders? Do I have to declare bankruptcy?
