I sent my car to my regular car dealer for routine car servicing today, and collected the car at the end of the day. When i reached my home (about 10 min drive), i noticed smoke coming out from the car bonnet.

I killed the engine immediately and when i opened up the engine bonnet, there was still lots of smoke coming out. Upon further inspection, I saw a piece of cloth left just under the car engine... and then suddenly the car engine caught fire from the burning and overheated cloth! This was really a shock to me and luckily my neighbor was around to help us put out the fire before it went out of control. Luckily no one was injured during the incident.

My wife recorded the whole incident on video, and we still have the partly burnt cloth left behind by the car mechanic. I am not sure how much damage had been caused to the car engine by the fire.

Can I claim compensation from the Car Dealer or even sue them for negligence with potential danger to my family's safety?

Yes, but you would have to prove that the mechanic had left the cloth under the bonnet. They could say that it was there previous and may have moved or/and that they do not use this type of cloth for cleaning, etc, - it is not theirs!

If the dealer is "any good", they will do the repairs without hesitation. Try this aproach first.

Thanks guys. Brought the car back to the servicing company. They took the car back for a complete check plus wiring inspection. They will repair any damage caused by the fire.

They also waived the fee for the servicing, and provided us with a replacement car for the next 2 days.

Sound like a good outcome, I guess the initial problem was due to a mistake by one of the employees, but if they put everything right, that should be the end of the matter.
