My mother died 3.5 years ago leaving a sizable estate with businesses with good incomes. The executor who also does the accounts for these businesses has not provided any estate accounting for the 3.5 years. We are about to return for another Status Hearing, the time set to complete mediation. We know there was never an intention to go through the mediation process. To access the estate accounts which legally are due to be provided to me as a major beneficiary we thought that we could request that the court appoint an independent accountant to audit the estate. As the Executor has refused to proved any info, bar that there is no residual estate, when there has been 2mill dollars earned by the estate in the past 3.5 years. Is there any precedent whereby you can ask the court for an independent audit of an estate.
The other approach you may each have, especially if you suspect that the executor is stringing you along, is to apply to the court for a new executor to be appointed. But you will need some evidence of all not being kosher before that tack will work.
See a solicitor who works with deceased estate if you need some assistance doing this.
