QuoteReplyTopic: Citizenship after visa cancellation notice Posted: 30/May/2012 at 19:49
I came to Australia on residency in 2008 from India. In 2010 on doubt of false passport I was served visa cancellation notice but I got that waived through proving it wrong and saved my residency. I haven't travelled overseas since 2008. Now I want to apply for Australian citizenship, do I need to give police clearance from India.
I do not want to go to Indian embassy as they seized my Indian passport and do not want to give me any service I need. Do I need to submit any documents attested by Indian embassy for Australian citizenship? Will my past immigration case be considered while giving me citizenship? Is there any possibility for Indian embassy be contacted by Australian immigration before granting me citizenship?

If you have been here since 2008, I would imagine that an Australian police check would be all that is required.
However I am concerned that you are reluctant to go to the Indian embassy, is there something that you are not telling us?
I expect that Australian authorities would consult the Indian authorities to see if you are wanted in that country for anything that is a crime if it were committed in this country, but I don't know for sure.
However if you could explain your reluctance to go to the Indian embassy, it may put us in a better position to find out if there is anything you should be concerned about.

I can understand your dilemna! As far as I recall, apart from a criminal clearance cert (which your relatives in India could obtain maybe) I don't think you'll need to go the Indian embassy at all if you're already here.
MartinO - quite often other countries do grab passports and hold them for ransom in these situations - they figure the guy is in Oz earning plenty and they want some. Don't assume he is a criminal.

Conrad Black is back in his home in Toronto. News that Conrad Black had been given permission to reside in Canada made headlines all across Canada and was in almost every Canadian newspaper. It sent Parliament in to a wild frenzy.
Why all the fuss? Conrad Black was once a mighty media mogul in Canada. The Montreal-born businessman was convicted in Chicago in 2007 of three counts of fraud and one count of obstruction of justice over the misappropriation of money at newspaper giant Hollinger International Inc. Black was sentenced to 6 years in prison. After launching several appeals Black had a few of his fraud convictions struck down and he was re-sentenced to 42 months in prison.

Iam relunctant to go to Indian embassy as i said earlier they have confiscated my passport. And i think my ex-wife has written to Minister of Immigration asking to cancel my visa on passport fraud. she has also asked why at the first instance when I was served with notice of visa cancellation last year why I wasn't deported. Although I got visa cancellation notice waived last year am I still at risk. What if indian high commision writes to australian immigration that my passport was confiscated
