Hi I am wanting some general information on a the time frame for a claim to a superannuation company.
My Son died in Feb 2010. Super company was ready to payout in December 2011 and then gets a claim from a person who had been seeing my son on & off for around 5 to 7 months.
Claim was made approx 12.12.2011
We(my lawyers)have contacted the super company and they have said that:-

"We refer to the above matter and advise that we have been contacted by Sunsuper who advise that they are awaiting for further information from the claimant. He advised if they received the documents within the next couple of weeks then the matter will be heard at the end of June 2012. The Trustees only meet at the end of each month, therefore if the documents do not come in by mid June then it won't be heard until July."

As there is a 28 day period for objections, is there a time frame that the claimant needs to supply these documents/information?

When I was notified that a claim had been made, I only had 28 days to respond and get my information to them!
So what would be the difference?
Is there a time limit from the time of death to put in a claim with the superannuation companies. (I thought it was 6 months)
It seems to be dragging on and costing a pretty penny for lawyers!
Closure with this would be nice!
Just wanting some other opinions
Thanks K

Ask the super fund what time limits apply in your situation.
I am NOT a lawyer. Anything said is NOT legal advice.

Please post your legal questions in a forum rather than sending a PM. Thanks.
