QuoteReplyTopic: Visa Cancellation Posted: 01/October/2010 at 08:38
Just a quick question if anyone can help me with it. I have sponsored my wife on spouse visa here in Australia and its been a year now. We had couple of problems that are still going on and things are not good. Now i am wondering to withdraw the sponsorship and she has already contacted different lawyers on how can she change her visa status to a PR coz immigration will see the consequences and may take a decision from either cancellation to grant of permanent residency which i am not in favour of her getting the PR so what if she is overseas and i cancel/withdraw my sponsorship will her visa be cancelled ? coz she is not in Australia any more and not surre if Australian Govt./imiigration is not responsible for her if she is overseas. If anyone could please help me with this ?
Coz that is her first priority to get PR or in other words her aim to get here is for PR and thts why i dont want her to get PR. If you can please let me know how will it work in the case explained above.
Aman, you seem to be motivated by spitefulness. You are in Australia, and we do not believe that being spiteful is the Australian way of doing things.
If you no longer wish to support her in her application because your relationship has broken down, and if she has left you, I believe you are required to advise immigration. But do this because you are required to, not out of a nasty spiteful outlook on life. These attitudes should be left elsewhere, this is Australia, where people get on with other people and don't do nasty things to them.
That is why people want to come here, because it is a nice place. Please help keep it that way.
Alternatively the two of you could visit Relationships Australia, and let them assist you to resolve your differences, so the two of you can join with the rest of us in a peaceful way of life, away from the torments that are happening in so many other places.
I am NOT a lawyer. Anything said is NOT legal advice.
Please post your legal questions in a forum rather than sending a PM. Thanks.
Hi Martino, i totally understand where you are coming from and i totally support Australian values and respect them but for every relationship there are different circumstances and just for her safety reason and her family wants her to be back home where as she doesn't want to be...
Sorry to hear about the breakdown but from personal experience i too am in the same situation as you. My partner recently just left me and took off he is currently somewhere in aus. I have contacted immigration, I was told to forward a letter advising the relationship breakdown - which I have done. I rang to confirm the receipt of letter, which they have received only to be told it is now in between themselves and my x partner. They said they will contact him to confirm the breakdown of relationship and give him his options. However, when we applied for the visa i roughly remember seeing a clause about the breakdown and him having 28 days to leave the country upon immigration accepting both parties acknowledgement. I was also told it could take a few weeks to a few months. Good luck
