of cause there is the judge that we all hope gives a fair sentencing... in this case, I am sure you'll be fine... I am hopeful that in australia the judges are not out there to make a person with human conscience suffer too much pain.
Hi, Its me again, - well I have my paperwork and am due to appear for a "mention" on the 11th of Feb - I'm soo scared its obsessive - I'm REALLY hoping for a kind magistrate and the amount has gone up to approx 7 thousand!!! I've paid back nearly half but I'm still terrified for my kids. Any advice or thoughts would be greatly appreciated.
All the mention will be is to set a date for the matter to be heard, and perhaps receive any documentation, including the fact that you are making repayments and the details of the amount repaid at that date, the more that it is the better you will present to the court.
Be very respectful and show remorse, it will stand you in good stead.

How come the amount has gone up to $7,000? Yes if you plead guilty it will be heard on the day, however if you did not steal $7,000 I do not believe you should plead guilty to that. You could have him talk to the prosecution and say that you are willing to plead guilty to a lesser amount. Make that the amount that you actually did steal. They may accept that, and then the case could proceed right away. The advantage is that you then may not be required to make restitution of the other amount that you did not steal.

Please don't stress, I have just come thru the same thing. The judge said that there are too many people stealing from employers and it needs to be stopped, and that perhaps they should start jailing people. For me I nearly died and was sure I was a gonna. But instead I am effectively on a 6mth parole - I guess they call it a wholly suspended sentence and that for for $8K. Its not nice to go thru, but at least I am getting the help I need. So keep your chin up, and stay positive
Hi all, I'm back again - well my court date was supposed to be tomorrow but my lawyer rang me at around 4 o clock and said he wanted to adjourn it for a month. He wants to talk to the prosecuter about have some charges withdrawn so he told me not to go tomorrow at all so i 'm not going but instead ring him in the morn to find out what happens next. I'll keep you posted with what punishment I get. Thanks everyone for being there for me.
hmmmm.... I just wanted to give some information on what happened. I know that it's been a couple of years since the court date but I had alot to get fixed and cutting down expenses such as the internet, phone, etc.. had to go. Anyway, I got a 12 month good behaviour bond and a no conviction. I had to pay restitution of $5,600 of which I'm still making payments - no court fees. I learnt so much and am soooo very lucky. I really just want to say A HUGE THANK YOU to everyone for being there for me and my family. OMG THANK YOU!!!!
