Hi

My elderly father has been sharing a rental property with my brother and they were both named on the lease, but the bond is in my Dads name.
They have been given notice to vacate at the end of the lease. My brother has already moved out and refuses to pay his share of the remaining 4 weeks rent and is no longer speaking to my father. Is there any legal way I can get him to pay?

There is no way you personally can get him to pay. Your father would be able to make a small claim in the local court for your brothers share of the rent.

With both of them on the lease they're both liable for the unpaid rent. If the full amount is not paid, the real estate agent can pursue either party or both for the rent.

Many thanks for the advise, I guess my Dad will have to pay the whole amount and put it down to experience. It will be hard for him, being a pensioner, but luckily he still has two daughters who are happy to help him out financially and emotionally.
