Do I need a lawyer to sell my property?

Hi all. I'm putting my house up for sale privatly and am wondering if I need a lawyer to do this? And what exactly does a lawyer do when selling a house? I know what they do (or are supposed to do, as mine didn't do the searches when I was buying this property!) when buying, but all I can think of is that they handle the payments owed etc?

No, you do not need a lawyer for a simple property sale.

The purchasers lawyer will prepare the transfer documents for your signature and seek your advice as to how to deal with the funds, ie you get to nominate the bank account for deposit, or opt to pick up a cheque etc.

However if there is a hiccup during the sale, eg the purchaser does not come up with the cash, or finds something wrong with the house and attempts to get you to fix it (many do this but contracts don't allow for a variation on the sale price) you may need legal assistance to sort it out. Time enough to get a solicitor involved then, if it gets too hard.

You could always have a conveyancer prepare the contract, which is the difficult part. You want to make sure you have a contract that covers you in case anything should go wrong.

But there are some things you are required to do as a purchaser, and if not done, you may be liable. That's why it's always a good idea to get legal advice.

I'm not sure what "YOU WAN? KFC" maybe some English lessons? I have learned that you DO NOT always get what you pay for. I have spent a LOT of money on lawyers, and in each experience they have been dreadful. So please don't troll me or lecture me. Thank you.

and other guys, thanks for your advice. I'm getting a contract from a private sale place, I will have a look over it, and probably follow martinO's advice on getting a lawyer if things get sticky. Thanks
