Hi there,  Would appreciate some help.  The following is summary of our life situation and issue

  • Partner and I met in 1999.  My partner obtained temporary residency in Jan 2002.  We married in Australia in March 2002.  My husband obtained permanent residency in January 2004 and thus a 5 year Resident Return Visa.
  • Since obtaining residency we have travelled a little and have lived in his home country of Norway.  We are currently living in Norway but lived in Australia for one year in 2005.
  • We had not planned to be in Norway as long as we have been but life got complicated with the death of several of his immediate family members and the loss of our daughter in 2003 at 5 days old.  Our 2nd child also had problems in the pregnancy during 2004 and then since being born in 2005 has had several cancer scares and a couple of operations.  We are expecting our 3rd child any day (problem free!) and notably our 2nd child has Australian Citizenship by Decent and an Australian Passport.
  • My husband's Resident Return Visa is due for renewal in January 2009.  We understand that there is the rule that to be eligible to renew you must have lived in Australia 2 of the 5 years of the RRV and that 1 of these yrs must be within the last 2 yrs.  Norway will not allow my husband to have dual citizenship.  Does this mean we are forever bound by the 5 year rules of the RRV?  Notably, if my husband gives up his Norwegian Citizenship, then I am not allowed to live and work in Norway.  What is our genuine little family suppose to do in this situation?  Ultimately we would like our lifestyle to be such that we can live between the countries so that our children are bought up in both cultures and such that neither of us are expected to give up our family, friends or culture.  Norway is flexible with me- I can come and go from the country as I like and are treated in most respects like a citizen.  In contrast Australian Immigration looks like making our lives difficult and this seems ironic when my husband has an Australian degree, has been a taxpaying worker, worked volunteer with Australian youths with drug and alcohol issues and when he has such strong family ties to Australia.
