Topic: Moving Ex's stuff out Posted: 15/June/2012 at 10:51
I have two rooms of ex's stuff that I have carefully packed in boxes. It has been there for 2/12 years. I have made several attempts at arranging for it to be delivered to him. Despite me organising it and paying for it, he refuses to accept it "I am not ready" "don't have a fence" etc etc
I am really wanting to move on, and am planning to write a letter (as I get abused on the phone) saying what date, time and location it is being moved to, and if he is not there, then it will go to the Salvos.
Thoughts anyone?

Your proposal seems a good solution. Be reasonable with you selection and the date and time, so that he can get there, and give him plenty of notice.
I am NOT a lawyer. Anything said is NOT legal advice.
Please post your legal questions in a forum rather than sending a PM. Thanks.

Thanks MartinO, I wanted a second opinion on how reasonable that was, I end up often feeling I am in the wrong!

I'd have my lawyer draft a letter to him, document in the letter the history, the previous attempts, and outline what he needs to do (and importantly by when), and outline what you'll after that time if he doesnt take action.
Then send away.
Not legal advice.

Greatdad, it is shameful the amount of money that has been spent between us on lawyers, and I would rather try doing this directly rather that blowing some cash on it, as rather sick of goign through lawyers every time I want to sneeze.

Might be worth sending the letter as a registered letter so he has to sign for it. That way he can't say he didn't receive it.

I agree with all the above, however if you know where he lives, is it possible to just drop the stuff on his property (with a waterproof cover if there is no cover). Once it's on his property it's his responsibility.
You could have a friend accompany you & take a photo as proof in case he denies having received it, or arrange with a police patrol to meet you there at a specific time as a standby breach of peace.
If he's still messing you around after 2.5 years, this is clearly not property he has any particular need for & is more than likely just a way of pi**ing you off.
Any opinion given should not be accepted as legal advice.
Please post your legal questions in a forum rather than sending a PM. Thanks

Yes indeed jaazzz it is pi**ing me off! I just thought of selling the stuff too, as you say, he has been very obstructive. At a mediation last year sometime, he said it was stuff he left for the kids' use. Oh really? A compressor and circular saw? lol

One tactic would be to send him a letter advising that the children have decided that they have no need for this equipment, therefore, they are going to sell it and divvy up the money amongst them for things they do want.
Let's see if that gets him moving.

If he has advised you verbally or in writing that the stuff is for his kids, then he has relinquised ownership and as smurfergirl said, I would be selling it. He has abandoned the goods with you for 2•5 years so he obviously has no intention of wanting them.
Sell them.
