According to the information released by DIMIA about processing times for various visa categories the average processing time for a subclass 309 Spouse (Provisional) visa in Dubai is 52 weeks.  This was as of June 2005 and is based on an average of 54 cases.

Of these cases, 25% were processed in an average time of 17 weeks.

In spouse cases much depends on how well the application is prepared in the first instance.  If documents or evidence are missing much time is lost when follow-up requests are made by the case officer.  Therefore, in your case, I am not able to offer any useful comment as I do not know how thoroughly the case was prepared.

Thanks a lot for the reply, also I have a question about the overseas divorce  if the consulate will accept it?

I submitted a divorce proof of my previous wife, which I sponsored 1997 and granted visa 1998.

The divorce proof is from a court in Dubai where I married my previous wife.

Thanks

I'm not familiar with the documentary evidence available in Dubai but so long as it is the official evidence used in Dubai it should be OK.  Remember that the Australian consulate will need the original or a certified copy of the divorce certificate.
