Hi

My two brothers and I are joint Executors to our late mums estate. One of my brothers (a career Criminal) committed fraud against the estate for just under $200,000 and has been sentenced to 5 years by the courts for this and a related fraud. He is currently in prison for this crime.

We want to remove him from being a joint executor as he is an unfit person for this position.

How do we do this ? and what would it cost ?

See a solicitor, if he is serving a sentence for fraud against the estate, it should not be difficult to do, any competent solicitor should be able to file the required application to have him removed as a joint executor. Ask the solicitor for a quote. Check with the law society in your state for an estimate of costs.
