Hey guys! Need a bit of help
So I sold my car to a friend in January 2017. I trusted him enough to let him go on a payment plan. Big mistake.
The payment plan was $2000 upfront, $2500 to pay with 2x $1000 payments and 1x $500 by September 28th, 2017. This is Cleary stated on a argeement will his signature on it.
Currently I have received a payment of $500 and another payment of $800.
I have sent him messages confirming the due by date and he basically told me to f*** off and that he doesn't have the money.
Now it being October 18th, 2017 he has informed me that he is currently in the process of completing a part 9 and the creditor company will be in contact with me and I will be receiving small sum payments.
What should I do about this?
It's really not ideal that I receive small sum payments and I'm quite annoyed and feel as if it's now out of my hands.
Is there anything I can do about this?

Is there anything in your agreement with him as to when title to the car passes to him?

Just the hand written receipt with the date of purchase. I wouldn't want to take back the car though as he has now left it unregistered and unroadworthy. 😔

A small claims case for the missing payments seems to be the only course you can follow. You'll need some proof, text and email may be sufficient if they show any acknowledgment by him of the amount owing.
