My ex husband has had an ABN for 10 years, he is not registered for GST. He is a rural contractor. For the past 10 years he has charged GST to his clients. He has not paid GST to the ATO, lodged BAS statements, or done his tax return in this time.

Is this illegal? What are the penalties he could face?

This is between your ex-husband and the ATO, it is not your concern. You and your former husband have parted because you could not get along, you should not be involving yourself in anything to do with him that also does not involve yourself.

I guess you do not wish to be in next years headlines see what happens to former partners sometimes.
