Hi guys, In the past this forum has been a great source of info so thought it would again be my best bet. I have been searching the internet for detail info on my questions regarding filling out of the "Form 3" for a minor civil claim. The following questions are in relation to South Australia, and specifically the magistrates court
I am up to the stage where I am taking legal action against a uninsured driver that was involved in a accident with me. I have since sent all the required documents etc and am now at the stage where I am filling out the "form 3"
I have logged into the e-filling website and began to fill out the information here but I have a few questions I can not seem to answer.
1) In the "Reason and Dates for Claim" section is it preferred to just be real basic (car accident details and what time etc) or is it better to be far far more specific in reference to communication between parties, what time, what what said, whats days, when letters where sent, etc. As I am not afraid to write every detail and then back it all up with documentation (see question 2)
2) It says to attach relevant document ion including vehicle evaluation etc, should I just attach this document or again is all the info, Letters, Text messages (print outs) better to be attached or should I keep this all for the court room?
3) When I "lodge" it online it says it will take a maximum of 72hrs to be returned to me, does it then mean I have to go to the nearest court and lodge it there after I receive it back in the post? or becuase I did it online is it lodged for me?
4) It says I also need to attach form 17 (Multi-language form) do I need to attach any other legal forms?
