Hey everyone i hope someone can help me on this... i have a aunty who has a mental illness for the last 30 years ... my mother who is her sister took on her power of attorney along time ago ... for the last 10 years or more she has been living in another country she ran away ... my aunty lives close to me and as my mother has ran away ... i felt as if she has left the responsibility behind for a long time now ... she claims to care but i am the only one who goes to visit my aunty and the nursing home always rings me on matters as they wont ring my mother overseas because of the call costs i guess... i believe i am the best for in making decisions now and have always been there when she needed things .. im the only one who makes a effort and who cares about her well being and happiness .. i believe i should be her power of attorney but my mother aint going to sign that over to me ... what am i to do because my aunty cant speak for herself ... and my mother is trying to stay as her attorney of power for her selfish reasons ... i am willing to do anything for my aunty because i love her to death ... any advice would be much appreciated thank you

Is your Aunt mentally capable to sign a new power of attorney? If so have a new one drawn up appointing yourself, and have her revoke the other one.

Your mother cannot appoint you to take over her duties even if you could contact her.

If she is not capable the only people who can intervene are the State's adult guardian. See a solicitor before you go down that track because there can be some drawbacks.
I am NOT a lawyer. Anything said is NOT legal advice.

Please post your legal questions in a forum rather than sending a PM. Thanks.
