Hi All,

We own a shop in a small country town and the shop sign which is about 1klm from the shop has been painted over. We are pretty sure of who did this... Do I go to the police? Can they be prosecuted for vandalism?

Yes they could.   But, having an idea and having evidence are two wildly different positions.

Thanks for that....Yes we have the evidence, the person also had a motive, we have witnesses to back it up... it's pretty cut and dry. It's whether I go down that path of prosecution or hope he owns up and apologizes and pays for a new sign.

Before you start pursuing him, check your own legal position first. Do you have a permit for the sign from your local council? It would be bloody stupid to go into the cop shop expecting your competitor to be penalized and walk out with a fine yourself.

Do you have witnessess to him doing the actual damage?

Without witnessess to the actual offence being committed and without him making admissions to doing the damage you have no chance of him being charged.
