Good Morning Everyone,
                      Recently i had a storage unit that i am currently renting robbed this was not a single break in there were at least three other units that suffered the same fate as did i the locks were cut with boltcutters and every spanner/socket/screwdriver etc etc and along with every power tool that i owned was all taken.

Now despite that fact that the police tried to ring me once on the day after the robbery but got no answer left no message and the only time that i have spoken to them was when i rang them they are not my main concern my main concern is the estate agent that i rent from the professionals in Esperance you see when they rang me to tell me that my lock had been cut and to go down and check to see if i had been robbed when i got there around lunchtime on the 20th of October i found that there were fencing going up across the front to completely closing the units in but as i found out this work had taken several days this rang alarm bells in that agents are not very forthcoming when it comes to spending there clients money after a bit more work i found out the several other units in the immediate vacinity had been robbed and when i spoke to the managing agent she told me that the fencing had gone up to save the owners from the costs of replacing the roller doors that had been the previous targets i do not know if these were in our block or another one but i then questioned the agent about her duty of care to her tennants to make just a simple phone call to say look there have been robberies you may want to upgrade the lock on your unit i would have thought a fair question and she did agree that she should have perhaps told the tennants.

And so after all of that my question is does someone like an estate agent have a duty of disclosure to tell there tennants about robberies in the immediate area and if they do and they do not do that can they be held accountable for property stolen from those properties especially when it is hard to say that they had no idea if our units would be targetted when you spend a lot of money to secure your property

The question really comes down to, what value of goods did you lose, did you have insurance on these.

If you were insured, the insurance should cover your loses and then it is up to them to take on the owners of the complex.

If you were not insured, you will have to take them on for what ever loss you suffered. Be aware a good read of the contract you have with them would be necessary first to see if they have some escape built into it.

The agent is the owners agent and has to do what the owner requires.

I agree the nexus between any duty of care to warn you the lessee that there are burglaries in the area and therefore you should be careful of your belongings in the garage, and their role as agent for the owner, is too remote for you to take legal action against them for negligence. IMO
Never the less they should have warned you anyway.
